General Terms and Conditions

Part I – Courses

These Terms and Conditions shall be deemed agreed for services provided between McKiev GbR, Frankfurt am Main, represented by Natalia Makievski and Stephan Makievski, hereinafter briefly referred to as “McKiev”, and its contractual partners, hereinafter referred to as “Course Participants”.

Course Participants may be individual natural persons who are of legal age and have full legal capacity.

1. Course Offer

McKiev plans, organizes and conducts the following courses:

  • Course No. 01. Drawing Course – Fundamentals: Still Life, Portrait, Figure, Perspective and Composition
  • Course No. 02. Painting: Oil, Acrylic, Watercolor
  • Course Nos. K1, K2, K3. Sculpture and Modeling in Clay: Portrait, Figure, Relief, Vessel
  • Course No. 04. Tai Chi Chuan, Qi Gong

2. Course Duration and Course Schedule

The courses are ongoing. The observance of school holiday periods and public holidays shall be arranged in consultation with the Course Participants.

Courses 01, 02 and K1–K3 are divided into units of 16 hours each; Course 04 is divided into units of 18 hours.

For Courses 01, 02 and K1–K3, the weekly class duration is 120 minutes; for Course 04, the weekly class duration is 90 minutes. Classes take place in the McKiev studio premises.

For Courses 01, 02 and K1–K3, participants are advised to bring suitable work clothing.

Courses begin and end punctually at the times specified in the respective course description.

Completed works may not be stored for longer than 4 weeks. McKiev assumes no liability for works that are not collected in time.

3. Course Fees

The current course fee for Courses 01 and 02 is €300.00, and for Courses K1–K3 €353.00, including 19% VAT and material and firing costs for 16 hours. The fee for Course 04 is currently €190.00, including 19% VAT, for 18 hours. The fee shall be paid in advance, no later than one week before the start of the course or the beginning of the next course unit.

Any material costs incurred shall be itemized on the invoice. Payment shall be made upon receipt of the invoice or by direct debit.

McKiev reserves the right to adjust its prices in accordance with market conditions. Participants will be informed of any such changes at least four weeks before they take effect, where applicable.

Participants attending two or more courses simultaneously shall receive a 5% discount on the fee for the second course.

For participants who live in the same household and both attend McKiev courses during the same period, a family discount of 5% shall be granted to one person on the course fee.

4. Cancellation of Classes

If a Course Participant is unable to attend a class due to illness or for another reason attributable to the participant, no reimbursement of the course fee shall be made. If the participant provides timely notice of absence, the participant may arrange a make-up session, which must be attended within the 8-week course period.

If a class is cancelled for reasons attributable to McKiev, an alternative date shall be offered, or any fee already paid shall be credited toward the next course unit.

No further claims shall arise.

5. Accident Insurance and Disclaimer of Liability

Participation in all courses and events offered by McKiev is voluntary and at the participant’s own risk. McKiev accepts no liability for damages of any kind.

There is no statutory accident insurance coverage for Course Participants. Participants are instead responsible for obtaining appropriate private insurance coverage.

All information regarding dates, names, locations, prices and other details is provided without guarantee.

6. Termination and Notice Period

The contract may be terminated by either contractual partner at any time with effect from the end of the respective course unit, without stating a reason and subject to compliance with the notice period.

The notice period is 2 weeks. Termination must be made in writing.

7. Validity of the Contract

The contract shall become valid upon signature by both contractual partners.

Any amendments, additions or other changes or cancellations of the contract must be made in writing.

Part II – Workshop and Seminar Terms and Conditions

The following terms and conditions apply to all seminars and workshops offered by McKiev. They do not apply to bookings made by companies or institutions. Companies or institutions wishing to arrange participation for their employees are kindly requested to contact us by telephone.

Registration / Registration Confirmation / Invoice

Please use the booking form on this website to register.

Individual natural persons who are of legal age and have full legal capacity may register.

After successful registration (reservation), all participants will receive a registration confirmation and an invoice for the seminar fee by email. If you would also like to receive confirmations and invoices by post, please indicate this separately when registering.

Payment

The fee may be paid by bank transfer. The seminar fee is due 10 days after receipt of the invoice, but no later than the start of the seminar.

Upon request, participants will receive a certificate of participation after completing the seminar. This certificate will not be sent automatically.

Cancellation by the Organizer

McKiev is entitled, on a case-by-case basis, to cancel an event if the required minimum number of participants has not been reached or if circumstances arise that make it impossible to conduct the event for important reasons (e.g. the instructor becoming ill at short notice).

In such cases, any event fees already paid will be refunded in full. Participants shall have no further claims.

Cancellation by Participants

Cancellation or withdrawal from a seminar or weekend event must be made in writing.

If the participant withdraws more than 14 days before the start of the event, 100% of the fee will be refunded.

Cancellation within 14 days before the start of the seminar

A refund of the seminar fee within 14 days before the start of the event, less a €25.00 processing fee, will only be made if the reserved place can be taken by a replacement participant who registers for and attends the same seminar, or if the registered participant provides a replacement participant.

Otherwise, the participant shall be required to pay 50% of the seminar fee. This also applies in the event of short-notice cancellation due to illness.

Cancellation within 7 days before the start of the seminar

A refund of the seminar fee, less a €25.00 processing fee, will only be made if the reserved place can be taken by a replacement participant who registers for and attends the same seminar, or if the registered participant provides a replacement participant.

Otherwise, the participant shall be required to pay 100% of the seminar fee. This also applies in the event of short-notice cancellation due to illness or discontinuation of participation in the course.

Data Protection

The collection, storage and processing of participants’ personal data shall take place exclusively within the framework of the German Federal Data Protection Act (Bundesdatenschutzgesetz – BDSG) and other applicable statutory provisions.

The stored data shall be used exclusively for sending information about events and newsletters from McKiev.

Participants are expressly informed that they may request the immediate deletion of their data after the event has been conducted and accounted for.

Liability of the Organizer

McKiev’s liability for damages, in particular to items brought by participants onto the event premises, shall be limited to cases of intent and gross negligence.

 

Part III – Right of Withdrawal

Right of Withdrawal for Consumers

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or self-employed professional activity.

Withdrawal Instructions

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the date on which the contract was concluded.

The right of withdrawal expires 14 days before the start of the seminar.

by means of a clear statement (e.g. a letter sent by post or an email) informing us of your decision to withdraw from this contract.

To comply with the withdrawal period, it is sufficient for you to send the notification concerning the exercise of your right of withdrawal before the withdrawal period expires. This does not apply during the 14-day period preceding the start of the seminar.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments we have received from you without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.

For this reimbursement, we shall use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no event will you be charged any fees as a result of this reimbursement.
