Part I – Courses
These conditions are considered agreed upon for services between McKiev GbR, Frankfurt am Main, represented by Natalia Makievski and Stephan Makievski, hereinafter “McKiev” and the contract partners, hereinafter “course participants”.
Course participants are individual, legally competent, natural persons of legal age.
1. Course Offer
McKiev plans, organizes, and carries out:
□ Course No. 1. Drawing, painting – basics: still life, portrait, figure, perspective, and composition
□ Course No. 2. Clay sculptures – portrait, figure, relief, vessel
□ Course No. 3. Tai Chi Chuan, Qigong (Tai Chi/Qigong)
2. Course Duration and Class Procedure
The courses are consecutive. Adherence to school vacation dates and holidays is based on coordination with the course participants.
Courses 1 and 2 are divided into 16-, course 3 into 18 hourly segments.
The respective class duration for courses 1 and 2 is: 120 minutes, for course 3: 90 minutes per week. Class is held in the premises of the McKiev studio.
For courses 1 and 2, it is recommended to bring along workwear.
The courses begin and end punctually, as specified in the course description.
The completed work pieces can not be stored for longer than 4 weeks. McKiev takes no responsibility for the receipt of work pieces which are not picked up in time.
3. Course Prices
The price for courses 1 and 2 is presently: 224 Euros incl. 19% VAT, plus material and firing costs by course 2, for a total of 16 hours; for course 3: 172 Euros, incl. 19% VAT for a total of 18 hours and is to be paid in advance, latest one week prior to the beginning of the course or the subsequent course. The incurred material costs will be billed and shown additionally. The fee is to be paid upon invoicing.
McKiev reserves the right to adjust the prices according to market conditions. If applicable, the course participants will be so notified at least four weeks prior to coming into effect. Upon participation in two or more courses simultaneously, a discount of 5% on the second course fee will be granted.
For the course participants who keep a joint household, and both attend courses at McKiev at the same time, a family discount of 5% on one of the two course fees will be granted.
4. Course Cancellation
Is the course participant unable to attend the course due to illness or another reason within his person, refund is not applicable. Upon cancellation in due time, a possible catch-up date may be arranged within the 8-week run of the ongoing course.
If the course should be cancelled due to reasons evoked by McKiev, an alternative date will be offered or already paid fees settled with the billing of the subsequent course section. Further claims are not applicable.
5. Accident Insurance and Disclaimer
The participation in all offered courses and events is at one’s own request and own risk. Liability can not be assumed by McKiev for damages of any kind. A statutory insurance does not exist. The course participant is much rather obliged to make appropriate provisions on his/her own.
All specification on dates, names, locations, prices, and other data supplied are without liability.
6. Cancellation, Cancellation Deadline
With adherence to the cancellation deadline, the contract can be cancelled at anytime by either contract partner without specification of reason for termination at the end of the respective course section. The cancellation deadline is 2 weeks. The cancellation must be presented in written form.
7. Contract Validity
The contract is valid with the signature of both contract parties, resp. upon activating the “Registration” button on the mckiev.de website.
Modifications, supplements, and other repeals must be presented in written form.
Part II – Workshop and Seminar Conditions
The following conditions apply to all McKiev seminars and workshops. They do not apply for bookings by companies or institutions. For inquiries from companies or institutions on participation of their employees, please contact us by telephone.
Registration / Registration confirmation / Invoice
Registration is made by completing the registration form on the mckiev.de website.
Individual, legally competent, natural persons of legal age can register.
The contract is valid upon activating the “Registration” button under the registration form on the mckiev.de website.
After activated registration (reservation), all course participants receive a registration confirmation and – as soon as the minimum course participant number is reached – an invoice for the seminar fee via email. Receipt of the confirmation and invoice is also possible by land mail if this is so requested at registration.
Payment
Payment of the fee is by bank transfer. The seminar fee is payable directly upon invoicing, latest however one week prior to the beginning of the course.
On request, course participants may receive a certificate of attendance upon completion of the seminar – it is not issued automatically.
Cancellation by the Organizer
In individual instances, McKiev may step back from carrying out an event, if the required number of course participants is not reached, or in cases that render the execution of an event impossible due to significant reasons, (i.e. illness of the instructor at short notice). In this case, course fees that have already been paid will be fully refunded. No further claims on the part of the course participants are applicable.
Cancellation by the Course Participant
Withdrawals from or cancellations of a seminar must be presented in written form. If a cancellation is submitted latest by 14 days prior to the beginning of the course, the course fee will be fully refunded.
Cancellation within 14 to 7 Days Prior to the Beginning of the Course
A refund of the course fee – minus 25 Euros handling charge – will be remitted only if the reserved slot can be filled by another person who registers for and participates in the same seminar. Otherwise, the course participant will pay 50% of the course fee. This also applies in case the cancellation is due to illness.
Cancellation within 7 Days Prior to the Beginning of the Course
A refund of the course fee – minus 25 Euros handling charge – will be remitted only if the reserved slot can be filled by another person who registers for and participates in the same seminar. Otherwise, the course participant will pay the full 100% of the course fee. This also applies in case the cancellation is due to illness or discontinuation of the participation in the course.
Privacy Statement
The assessment, storage and processing of the course participants’ personal data will be completed only in line with the German Data Protection Act (Bundesdatenschutzgesetz, BDSG) and other legal regulations. The acquired data serves only for the distribution of event information and McKiev newsletters. The course participants are explicitly made aware of the possibility of having their data deleted immediately upon completion and accounting of the event, if an according request is expressed.
Liability of the Organizer
McKiev’s liability for damages, in particular to items brought into the event site by the course participants, is limited to intention and gross negligence.
Right of Revocation by the Consumer
A consumer is any natural person who concludes a legal transaction for purposes that can not be predominantly attributed to their commercial or independent professional activity.
Revocation
The revocation deadline is 14 (fourteen) days from the contract conclusion date on.
You have the right to revoke your contract with McKiev, concluded as described above, within 14 (fourteen) days from the contract conclusion date without indication of reasons.
The revocation must be presented in written form.

It is considered adherence to the deadline if the statement of exercising your right of revocation is sent out within the revocation deadline.
The revocation entitlement expires 14 (fourteen) day prior to the beginning of the course.
Entailment of the Revocation
If you revoke your contract with McKiev, concluded as described above, we will refund all payments received from you directly and latest within fourteen days from the day onward on which the statement of your revocation was received.
For the refund, we will use the same form of transaction as your original payment was made by, unless something else has been explicitly agreed with you.
In the event of revocation within the deadline, you will incur no costs.
